This data is processed on the basis of Art. 6(1)(b) GDPR if your enquiry is related to the performance of a contract or is necessary for carrying out pre-contractual measures. In all other cases, the processing is based on our legitimate interest in effectively handling the enquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR), provided that this consent has been requested.

The data you send to us through contact enquiries will remain with us until you request its deletion, withdraw your consent to its storage or the purpose for storing the data no longer applies (e.g. after your enquiry has been fully processed). Mandatory statutory provisions – in particular statutory retention periods – remain unaffected.

Use of Payment Service Providers

Google Pay

If you choose the “Google Pay” payment method provided by Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland (“Google”), payment will be processed through the “Google Pay” application on your mobile device running at least Android 4.4 (“KitKat”) and equipped with NFC functionality by charging a payment card stored with Google Pay or a payment system verified there (e.g. PayPal). To authorise a payment of more than €25 via Google Pay, you must first unlock your mobile device using the configured verification method, such as facial recognition, a password, fingerprint or pattern.

For the purpose of processing the payment, the information you provide during the ordering process, together with information about your order, will be transmitted to Google. Google will then transmit the payment information stored in Google Pay to the originating website in the form of a unique transaction number used to verify that payment has been made. This transaction number does not contain any information about the actual payment details of the payment methods stored in Google Pay, but is generated and transmitted as a unique numerical token valid for one transaction only. In all transactions conducted via Google Pay, Google acts solely as an intermediary for processing the payment. The transaction is carried out exclusively between the user and the originating website by charging the payment method stored in Google Pay. Where personal data is processed as part of the transfers described above, such processing takes place exclusively for the purpose of payment processing in accordance with Art. 6(1)(b) GDPR.

Google reserves the right to collect, store and analyse certain transaction-specific information for every transaction conducted via Google Pay. This includes the date, time and amount of the transaction, the merchant’s location and description, a description of the purchased goods or services provided by the merchant, photos that you have attached to the transaction, the name and email address of the seller and buyer or sender and recipient, the payment method used, your description of the reason for the transaction and, where applicable, the offer associated with the transaction. According to Google, this processing is carried out exclusively in accordance with Art. 6(1)(f) GDPR on the basis of its legitimate interest in proper accounting, the verification of transaction data and the optimisation and maintenance of the Google Pay service. Google also reserves the right to combine the processed transaction data with other information collected and stored by Google when you use other Google services.

Apple Pay

If you choose the “Apple Pay” payment method provided by Apple Distribution International (Apple), Hollyhill Industrial Estate, Hollyhill, Cork, Ireland, payment will be processed using the “Apple Pay” function on your device running iOS, watchOS or macOS by charging a payment card stored in “Apple Pay”. Apple Pay uses security features integrated into your device’s hardware and software to protect your transactions. To authorise a payment, you must therefore enter a code previously set by you and verify the payment using the “Face ID” or “Touch ID” function of your device.

For the purpose of processing the payment, the information you provide during the ordering process, together with information about your order, will be transmitted to Apple in encrypted form. Apple then encrypts this data again using a developer-specific key before transmitting it to the payment service provider of the payment card stored in Apple Pay for payment processing. The encryption ensures that only the website through which the purchase was made can access the payment data. Once the payment has been completed, Apple sends your device account number and a transaction-specific dynamic security code to the originating website to confirm that the payment was successful. Where personal data is processed as part of the transfers described above, such processing takes place exclusively for the purpose of payment processing in accordance with Art. 6(1)(b) GDPR.

Apple stores anonymised transaction data, including the approximate purchase amount, the approximate date and time, and whether the transaction was successfully completed. The anonymisation process completely prevents the data from being linked to an individual. Apple uses the anonymised data to improve “Apple Pay” and other Apple products and services.

If you use Apple Pay on an iPhone or Apple Watch to complete a purchase made through Safari on a Mac, the Mac and the authorising device communicate via an encrypted channel on Apple’s servers. Apple does not process or store any of this information in a format that can be used to identify you. You can disable the option to use Apple Pay on your Mac in your iPhone settings. Go to "Wallet & Apple Pay" and disable "Allow Payments on Mac".

Social Media

Data Processing by Social Networks

We maintain publicly accessible profiles on social networks. The social networks we use are listed below.

Social networks such as Facebook, Google+ and others can generally analyse your user behaviour comprehensively when you visit their website or a website containing integrated social media content, such as Like buttons or advertising banners. Visiting our social media profiles triggers numerous data processing operations relevant to data protection.

In detail: If you are logged into your social media account and visit one of our social media profiles, the operator of the social media platform may associate this visit with your user account. Under certain circumstances, your personal data may also be collected even if you are not logged in or do not have an account with the respective social media platform. In this case, the data may be collected, for example, through cookies stored on your device or by recording your IP address.

Using the data collected in this way, the operators of social media platforms can create user profiles containing your preferences and interests. This allows interest-based advertising to be displayed to you both within and outside the respective social media platform. If you have an account with the respective social network, interest-based advertising may be displayed on all devices on which you are or have been logged in.

Please also note that we are unable to track all processing operations carried out on social media platforms. Depending on the provider, additional processing operations may therefore be carried out by the operators of the social media platforms. Legal Basis

Our social media profiles are intended to ensure the broadest possible presence on the internet. This constitutes a legitimate interest within the meaning of Art. 6(1)(f) GDPR. The analysis processes initiated by the social networks may be based on different legal grounds, which must be specified by the operators of the social networks, such as consent within the meaning of Art. 6(1)(a) GDPR.

Controller and Exercising Your Rights

When you visit one of our social media profiles, such as Facebook, we are jointly responsible with the operator of the social media platform for the data processing operations triggered by your visit. In principle, you may exercise your rights to access, rectification, deletion, restriction of processing, data portability and lodging a complaint both against us and against the operator of the respective social media platform, such as Facebook. Please note that, despite our joint responsibility with the operators of the social media platforms, we do not have full control over the data processing operations carried out by these platforms. Our options are largely determined by the corporate policies of the respective provider.

Storage Period

Data collected directly by us through our social media profiles will be deleted from our systems as soon as the purpose for its storage no longer applies, you request its deletion, you withdraw your consent to its storage or the purpose for storing the data ceases to apply. Stored cookies remain on your device until you delete them. Mandatory statutory provisions, particularly retention periods, remain unaffected. We have no influence over the storage period of data stored by the operators of social networks for their own purposes.
